Outside Virginia’s directory.
The Virginia Attorney General’s FAQ says products that do not contain any nicotine, “including even trace amounts,” are “not currently covered by the Directory statute.”
NoNic6 is 6-methylnicotine, a nicotine analog. Non-nicotine does not mean risk-free. NoNic6 may be addictive and acutely toxic.

The proof.
Open document Products that do not contain any nicotine, including even trace amounts, are not currently covered by the Directory statute. However, you may still need to obtain a retail tobacco permit from the Virginia Alcoholic Beverage Control Authority to sell vape products even if they do not contain nicotine.
A retail tobacco permit is required to sell “any electronic smoking device and any substances that may be aerosolized or vaporized by such device, whether or not the substance contains nicotine.”
As the Kumi 6 disposable vapor products do not contain nicotine, the products are not subject to Virginia’s Liquid Nicotine and Vapor Product directory law.
Know this.
- Hold a Virginia ABC retail tobacco permit at each location.
- The permit applies “whether or not the substance contains nicotine.”
- Confirm your tax treatment with the Department of Taxation.
